We Told You So! - Senate Report on Federal Overreach Confirms NCBA's Suspicions

In light of the report out yesterday by Oklahoma Senator Jim Inhofe, chairman of the Senate Environment & Public Works Committee, ag interest groups like the National Cattlemen's Beef Association are screaming 'We told you so,' as proof of overreach by the Environmental Protection Agency (EPA) and the Army Corps of Engineers was officially exposed in case studies listed in the report. Despite the US court system's order to stay any action under the Water of the US (WOTUS) ruling, the ag community has long suspected overreach like that described in the senate report, according to Scott Yager, environmental counsel for NCBA. Farm Director Ron Hays spoke to Yager about what purpose this report will serve now that it has been released.
"This report should absolutely support future legislation," Yager said. "Now there is evidence in front of these senators. There's evidence for them now, to show them that these issues are happening right now. We're hoping it will kick start the senate into passing some sort of compromise to fix these issues."
Yager described one case study in the report about a farmer in California that was told he needed a permit to plow a pasture he had been using to graze cattle on. Although the Clean Water Act provides agricultural exemptions for just this sort of thing, the Corps creatively circumvented this by insisting that the farmer was actually forming small mountain ranges.
"It's very troubling," Yager said. "There are problems, they're eroding agricultural exemptions - and they need to take action to fix it."
