BREAKING: US Court of Appeals In Favor of Ag Retailers Lawsuit Against OSHA on Retail Exemption

The United States Court of Appeals just ruled in favor of the Ag Retailers in their lawsuit against OSHA on their retail exemption policy. The court found that OSHA's redefinition of what constitutes a retail facility is considered equal to the issuance of a new safety "standard," and under the OSH act, all new "standards" must adhere to formal notice and comment procedural requirements. The court has vacated the OSHA policy.
"This ruling means Anhydrous ammonia facilities will not have to comply with the standards which I believe was supposed to go into effect October 1," said ODAFF CPS Director Kenny Naylor.
"This is big news for farmers and fertilizer retailers. Retail fertilizer distributors should not be treated the same as fertilizer manufacturers. We are thankful the court has agreed. We also thank our Oklahoma congressman for supporting legislation reining in the department of labor in the excessive regulation," said Oklahoma Secretary of Agriculture Jim Reese.
