Sue and Settle Works for Environmentalists- Tim Huelskamp of Kansas Offers Reaction

Today, the U.S. Fish & Wildlife Service (USFWS) listed the Lesser Prairie Chicken (LPC) as "Threatened." Congressman Tim Huelskamp of the Big First District which encompasses about the western half of the state of Kansas (where the Lesser Prairie Chicken calls home in that state) released the following statement:
"I am disappointed that the USFWS has chosen to list the Lesser Prairie Chicken as 'threatened.' However, I am glad that it was not listed as 'endangered,' thus protecting Kansans from an even heavier hand from Washington.
"The LPC was one of hundreds of species included in a settlement agreement between the Department of the Interior and litigious 'environmental' organizations. The listing proves once again that 'sue and settle' is taking the place of sound science. While experts agree that the historic drought choking the Great Plains is the primary cause of the LPC population reduction, the Obama administration is threatening the private property rights of farmers and ranchers, as well as threatening needed energy production.
"As one of their reasons for resisting the 'environmental' legal threat to list as 'endangered,' I am glad that USFWS does recognize that a multi-state effort is superior to the full federal control of the Endangered Species Act. Nevertheless, an effective conservation effort must be strictly voluntary if private property is to be respected and our rural way of life to be protected."
